At NEW YORK PILATES we respect your concerns about privacy. This policy is intended to ensure your information is handled in a safe and responsible manner. As we continue to evolve our Web site and incorporate new technologies to improve communication, our policies may change. We encourage you to refer to this policy on an ongoing basis to stay abreast of our most current Privacy Policy practices.
WHAT INFORMATION DO WE COLLECT?
Currently, NEW-YORK-PILATES.COM gathers information (such as name, e-mail address and zip code) strictly for contact purposes when users opt to fill out an e-mail submission form to inquire about our company and about membership. In some cases we ask for other optional information including additional contact information and certain demographic information (such as phone number and gender).
HOW DO WE USE YOUR INFORMATION?
We may use your information to communicate special offers, promotions and information about our company to you via email. If you do not wish to receive these emails you will have the option to opt out of future mailings (see the section below). We may also use your information to compile usage statistics and other data regarding the use of the Web site services. We will not share your personally identifiable information with third parties, outside of the limited circumstances referenced in the paragraph immediately below. We may, however, share with partners aggregated statistical data that includes users’ demographic information but does not identify them. At NEW YORK PILATES we respect your concerns about privacy. We collect email information to provide a more personalized and relevant experience. If you give us your email or SMS address on the home page, when you inquire about membership or sign up, we will send you emails or texts or other SMS messages about exclusive offers, news at NEW YORK PILATES and new club openings. If you have previously opted out of receiving emails or texts or other SMS messages from us, providing updated information will act as an ‘opt back-in’.
If you want to opt-out of receiving promotional emails or texts, simply click on the unsubscribe link located on the bottom of all of our emails or reply STOP to our SMS messages. Although we strive to update our email and SMS list as frequently as possible, you might receive another contact before we are able to remove you. Please note that you will continue to receive Member Services related communications as it pertains to your member account. NEW YORK PILATES may use any of your contact information held on file (including Email, Mailing, SMS & Text, Phone & Fax) to communicate with you in relation to day to day administrative activities, such as freeze requests, online purchases and important service alerts. NEW YORK PILATES never sells or rents your name, e-mail address, or any other personally identifiable information to third-parties.

Submissions
We welcome your feedback regarding the New York Pilate’s website as well as our studio. However, any comments, feedback, notes, messages, ideas, suggestions or other communications (collectively, “Comments”) sent to New York Pilates shall be and remain the exclusive property of New York Pilates. Your submission of any such Comments shall constitute an assignment to New York Pilates of all worldwide rights, titles and interests in all copyrights and other intellectual property rights in the Comments. New York Pilates will be entitled to use, reproduce, disclose, publish and distribute any material you submit for any purpose whatsoever, without restriction and without compensating you in any way.
For this reason, we ask that you not send us any comments that you do not wish to assign to us, including any confidential information or any original creative materials such as stories, product ideas, computer code or original artwork.
GIFT CARD TERMS AND CONDITIONS
The following terms and conditions (the “Terms and Conditions”) apply to any NEW YORK PILATES gift card originally purchased at any participating NEW YORK PILATES Fitness Club (“NEW YORK PILATES”) or on the NEW YORK PILATES.com website (the “NEW YORK PILATES Gift Card”). By purchasing an NEW YORK PILATES Gift Card, accepting and retaining an NEW YORK PILATES Gift Card or using an NEW YORK PILATES Gift Card, you agree to these Terms and Conditions. NEW YORK PILATES reserves the right to change, amend or terminate the Terms and Conditions of the NEW YORK PILATES Gift Card program at any time with or without notice in our sole discretion.
Use of the NEW YORK PILATES Gift Card
You may use the NEW YORK PILATES Gift Card only to purchase eligible merchandise and pay for services at any NEW YORK PILATES Fitness Club
Redemptions/Balances
Your use of the NEW YORK PILATES Gift Card is limited to the current dollar value held on the card. Restrictions

No Expiration Date/Service Charges
The NEW YORK PILATES Gift Card has no expiration date, service charges or dormancy fees.
Promotional Cards
These Terms and Conditions do not apply to gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”). Promotional Cards may have different terms and expiration dates to the extent permitted by applicable law.
Lost or Stolen Cards
Protect your NEW YORK PILATES Gift Card as if it were cash and safeguard the NEW YORK PILATES Gift Card from unauthorized use. Except where required by applicable law, neither Issuer nor NEW YORK PILATES is responsible for and will not replace NEW YORK PILATES Gift Cards if lost, stolen, damaged or destroyed.
Misuse of the Card
Issuer and/or NEW YORK PILATES reserves the right in its discretion to suspend or terminate use of any NEW YORK PILATES Gift Card if Issuer or NEW YORK PILATES suspects any fraud or misuse of an NEW YORK PILATES Gift Card. Issuer or NEW YORK PILATES may cancel the NEW YORK PILATES Gift Card at any time, without notice.
Property Rights
The consideration paid for the NEW YORK PILATES Gift Card, including any unredeemed balances, is the property of the Issuer.
No Warranties
Subject to applicable law, NEW YORK PILATES and Issuer make no warranties, express or implied, with respect to the NEW YORK PILATES Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. Neither Issuer nor NEW YORK PILATES assume any responsibility for any loss of any kind arising out of your use of any NEW YORK PILATES Gift Card. In the event a NEW YORK PILATES Gift Card is not functional, your sole remedy and Issuer’s and NEW YORK PILATES’s sole liability shall be the replacement of the NEW YORK PILATES Gift Card at its then-current value.
Governing Law
The laws of the Commonwealth of New York govern the Card and the Terms and Conditions of this Agreement, without regard to choice of law principles.
Severability
If any one or more of the provisions of these Terms & Conditions shall be for any reason whatsoever held invalid, then such provisions shall be deemed severable from the remaining provisions and shall in no way affect the validity or enforceability of the other provisions of these Terms & Conditions.
Entire Agreement
Except as specifically stated otherwise, these Terms & Conditions set forth the entire understanding relating to the subject matter hereof, and all prior understandings, written or oral, are superseded by these Terms & Conditions.

PROMOTIONAL GIFT CARD TERMS AND CONDITIONS
The following terms and conditions (the “Promotional Terms and Conditions”) apply to NEW YORK PILATES gift cards or other stored value cards that are given away for free or distributed as a reward, incentive, or as part of a marketing or promotional program (“Promotional Cards”). Promotional Cards are issued by EQ Services LLC, a Virginia limited liability company ( “Issuer”). By using, accepting and/or retaining a Promotional Card, you agree to these Promotional Terms and Conditions. NEW YORK PILATES reserves the right to change, amend or terminate the Promotional Terms and Conditions of the Promotional Card program at any time with or without notice in our sole discretion.
Use of the Promotional Card
You may use the NEW YORK PILATES Gift Card only to purchase eligible merchandise and pay for services at any NEW YORK PILATES Fitness Club (excluding cafes), The Spa and The Shop. You may not use the Promotional Card to pay for membership dues.
Redemptions/Balances
Your use of the Promotional Card is limited to the current dollar value held on the card. You may obtain your balance by presenting your Promotional Card at any NEW YORK PILATES Fitness Club. Promotional Cards may not be redeemed for cash.

PERSONAL TRAINING TERMS AND CONDITIONS
24 Hour Cancellation Policy
A NEW YORK PILATES member that has made an appointment for a session may cancel or change the time of the session provided that a minimum of 24-hours’ notice is given. You can make these changes via the Personal Training tab in your MYEQ account, or by contacting your trainer directly. Members will be charged for the full cost of the session on any late cancellations or no-show appointments.
Payments
Payment for sessions is required to be made by the member on or before the date of the session. If a member has no session inventory, charges for late cancellations or no show appointments for sessions will be charged to the member’s credit card on file with NEW YORK PILATES under the membership agreement. In addition, charges for sessions which are used by a member but not otherwise paid for will be charged to the member’s credit card on the day the session is used.
Discounts
NEW YORK PILATES may offer discounts on sessions to members who purchase a package of sessions. These discounts only apply to the number of sessions purchased as a group. Any further or additional sessions will be charged at the regular rate then in effect for individual sessions.
Expiration Policy
All sales are final. All Sessions and classes have expiration dates, please refer to your expiration dates on your Mindbody account.
RETURN AND EXCHANGE POLICY
MERCHANDISE
We want you to be completely satisfied with your New York Pilates order! Merchandise returns are accepted for merchandise exchanges under the condition that the receipt of purchase is presented and the item returned meets the acceptable conditions. New York Pilates does not refund original forms of payment.
Exchanges are awarded within 14 days of purchase under the conditions that the item has tags and packaging intact, clothing is unworn, unstained, and not damaged. Exchanged items will be shipped out upon receipt and approval of returned item. Shipping costs must be paid for in advance of product exchange. Allow up to 10 business days for return and exchange processing for online orders. Exchanges for different product size is not guaranteed.
Final sale items are not available for returns or product exchanges.
SERVICES
All products and services sold are nonexchangeable and nonrefundable. This applies to all services including Classes, Private Sessions, Workshops, and Packages. If you would like to request an extension of a Package due to COVID, please live chat us.
